🔫 General Firearm Sales

All firearms, magazines, receivers, and restricted items are sold and shipped in accordance with all existing federal, state, and local laws and regulations. Many of the firearms, magazines, and parts for sale on this website may be restricted or prohibited in your area. Please check your local and state regulations before ordering.

All new firearms are shipped in the original manufacturer's box, with magazine(s), accessories, and applicable warranty. Firearms sales are final. Firearms requiring warranty work must be returned to the factory within 1 year of purchase for repair. Accessories and special order items not normally sold by our store will not be covered under warranty even if these products are part of an integrated firearms package, unless we have guaranteed the entire package in writing. Please contact the original manufacturer for warranty information on all accessories and special order items.

📜 Layaway Firearms Online & FFL Transfers

It is illegal to ship firearms to anyone not holding an active Federal Firearms License (FFL). For that reason, firearms purchased online may be picked up at our store or shipped to an FFL (gun store) near you. We may contact and verify the FFL you select during checkout before we ship your firearm(s). The buyer is encouraged to contact the receiving FFL licensee before purchase.

🔄 Changing, Modifying & Defaulting Layaways

Modifying or Substituting Layaways

We try to serve customers as best we possibly can. If you have a layaway and want to change it, we can help you with that. The process is as follows: layaways that need to be modified will be cancelled and the customer will be charged a 20% restocking fee with the remainder being placed on a gift card. Layaway Guns is not able to place the order for the customer due to fraud prevention and sensitive information exchanged during transactions. At this point, transaction lead times restart.

Returns & Cancelled Layaways

If for any reason you need to cancel a layaway before the item ships, there is a 20% restocking fee. If the item has already shipped, the buyer is responsible for return shipping in addition to the 20% restocking fee. If the item has already been transferred to you from the receiving FFL, we are unable to accept a return.

Defaulted Layaways

Layaway Guns requires a 10% payment every 30 days. After 30 days, we provide an additional 15-day grace period. If we are unable to reach you after 45 days, your layaway will default due to non-payment and the items will be returned to store inventory. Unfortunately, no refunds are issued if a default occurs.

📦 Order Fulfillment & Shipping Policy

All orders are shipped promptly from our in-store inventory within 2 business days using UPS. Tracking numbers are provided for all UPS shipments. Our Flat Rate shipping policy applies strictly to the contiguous lower 48 United States. We currently do not offer shipping outside the lower 48 states or internationally; orders placed outside these boundaries will be cancelled.

Fraud Security Notice: Orders cannot be processed and will be flagged as potential fraud if the billing and shipping address do not match. Flagged orders will be refunded via gift card to allow placing the order correctly. If an order contains a serialized item or firearm, the system will route it to your selected FFL—DO NOT enter the FFL dealer's address as your shipping address.

📋 Affidavit of Customer

By purchasing from Layaway Guns, you certify and affirm the following statements:

• I am not an unlawful user of or addicted to any controlled substance.
• By selling or delivering ammunition or firearms to me, Layaway Guns is not violating any state or local law or ordinance.
• I have never been, and do not expect to be, convicted in any court of a misdemeanor crime of domestic violence.
• I am not under indictment for, and have never been convicted of, a crime punishable by imprisonment for a term exceeding one year.
• I am not a fugitive from justice.
• I am not currently subject to a restraining order of any kind.
• I have not been adjudicated as a mental defective, nor have I been committed to any mental institution.
• I am not an illegal or unlawful alien.
• I have never been discharged from the Armed Forces under dishonorable conditions.
• I am currently at least twenty-one (21) years of age.
• I have not renounced my U.S. citizenship.

Indemnification & Agreement to Defend

I fully agree that if any of my representations when making purchases under the Terms of Sale are incorrect, or if I fail to comply with these Terms of Sale, I will indemnify, defend, save harmless, and release Layaway Guns and its owners, agents, officers, and employees against any civil liability or criminal prosecution resulting from my purchase.

By placing an order, I release Layaway Guns from any and all liability arising from or related to the products purchased—including storage, transportation, handling, or use by myself or others.

Class Action Waiver

You expressly agree that any dispute resolution proceedings (including litigation, arbitration, and mediation) will be conducted only on an individual basis and not in a class, consolidated, or representative action. You acknowledge this as a knowing, voluntary, and permanent waiver of any right to bring class claims.

Trademarks & Copyright

Layaway Guns and associated marks are exclusive trademarks. All website content (text, graphics, logos, images, code) is the exclusive property of Layaway Guns and protected under U.S. and international copyright laws.

Protecting Your Account

You are responsible for safeguarding your unique username and password, and you accept full responsibility for all activities performed under your account.

What We Do With Your Information

When you purchase from our store, we collect personal information provided during checkout (name, address, email address). We also automatically receive your IP address to optimize browser performance. With your permission, we may send email marketing regarding store updates or new inventory.

Consent & Disclosure

When providing information to complete a transaction, verify credit cards, or arrange delivery/returns, implied consent is given for that specific purpose. You may withdraw marketing consent at any time by contacting us at: main@layawayguns.com. We may disclose personal information if required by law or upon violation of our Terms of Service.

Policy Changes
